1. Overview
Pick and Create is a digital design store. You browse a catalog of design files, templates, and Canva templates, spend credits to unlock the ones you want, and download or access them instantly. Credits are purchased in packs. Your use of the Service is subject to these Terms, our Privacy Policy, and any other policy referenced here.
2. Eligibility and Account Responsibility
You must be legally capable of entering a binding agreement and must provide accurate account information. You are responsible for safeguarding your account credentials and all activity under your account, whether you sign in with an email and password or through a connected provider like Google.
3. Credits and Purchases
Credits are purchased in packs through our payment provider, Lemon Squeezy, and are added to your account balance once payment is confirmed. Spending credits unlocks a specific design for your account — this grants access under the license in Section 5, it does not transfer ownership of the underlying design.
Credit purchases and digital downloads are final once a design has been unlocked. We do not offer refunds or exchanges for spent credits or unlocked designs, except where required by law. Unspent credit balances do not expire, but they have no cash value and cannot be exchanged for money.
4. How You Receive What You Buy
Depending on the product, unlocking it gives you either a downloadable file (delivered through a temporary, time-limited link) or a link to open and edit a Canva template in your own Canva account. For Canva templates, Pick and Create is not affiliated with, sponsored by, or endorsed by Canva — the link simply takes you to Canva's own editor to work on that design.
Once you've unlocked a design, you can return to your account at any time to download the file again or reopen the Canva link, for as long as the Service remains available.
5. License to Purchased Designs
When you unlock a design, we grant you a non-exclusive, non-transferable license to use it for personal and commercial projects (for example: products you sell, client work, or your own branding), unless a specific product states otherwise.
This license does not let you resell, redistribute, or share the design file itself — whether for free or for payment — as a standalone design, template, or file asset. You also may not claim you created the original design. Rights and ownership in every design remain with Pick and Create or its licensors.
6. Acceptable Use
You may not use the Service to violate laws, infringe intellectual property rights, distribute malware, engage in abuse, harassment, fraudulent activity, or deceptive practices, or to circumvent the credit system (including attempting to access paid designs without unlocking them). We may suspend or terminate accounts that violate these Terms.
7. Account Favorites and Download History
Your account keeps a record of designs you've favorited and unlocked, so you can find and re-download them later. If you delete your account, this history — and your ability to re-download previously unlocked designs — is deleted with it.
8. Intellectual Property
Pick and Create and its licensors retain all rights in the Service, including the website, software, catalog, branding, and every design in the store except to the extent a license is granted to you under Section 5. Except as expressly granted, no rights are transferred to you.
9. Third-Party Services
The Service uses third-party providers to operate, including Lemon Squeezy for payments and, for Canva templates, Canva itself once you follow an unlock link. Pick and Create is not responsible for third-party services, their terms, policies, uptime, or data practices.
10. Warranty Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not guarantee uninterrupted, secure, or error-free operation.
11. Limitation of Liability
To the maximum extent allowed by law, Pick and Create is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or business interruption, arising from your use of the Service.
12. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access for violations of these Terms, legal obligations, security risks, or misuse. Unspent credits are forfeited if your account is terminated for a violation of these Terms.
13. Contact and Updates
We may update these Terms periodically. Material updates will be posted on this page with a revised effective date. Continued use after updates means you accept the revised Terms.
